The Warning from Kerala: A Communist Reflection on the Failure of the LDF


In the political history of Kerala, the Left Democratic Front (LDF) has never been merely an electoral alliance. It has represented an ideological promise — a commitment to equality, social justice, and people-centric governance.

So when the Left faces electoral setbacks, it is not just a political event. It is a moment that demands introspection.

This is not a critique from outside. This is a reflection from within.

From Movement to Machinery

The strength of the Left once lay in its deep connection with the masses — workers, farmers, students, and the marginalized. It was a movement built on participation.

Today, there is a growing perception that this movement has gradually transformed into a machinery of governance.

  • Decision-making feels centralized
  • Cadres feel like implementers, not contributors
  • People feel heard less, managed more

For a communist movement, this shift is not minor — it is foundational.

The Burden of Continuous Power

Historically, Kerala’s electorate resisted prolonged single-front rule. The break in that pattern created a new political reality.

But with continuity came a silent cost:

  • Public fatigue
  • Reduced sensitivity in governance
  • Perception of power consolidation

Even effective administration cannot fully erase the psychological weight of long-term incumbency.

The message from voters is not always anger — sometimes it is exhaustion.

Ministerial Disconnect: Perception vs Performance

Many ministers have worked. That is undeniable.

But politics is not only about work — it is about perception, communication, and emotional connection.

  • Communication Gap: Achievements did not translate into public understanding.
  • Public Arrogance (Perceived or Real): Leadership appeared dismissive of criticism.
  • Ethical Shadows: Allegations created doubt, affecting moral credibility.

The Changing Class Base

Kerala is no longer the Kerala of the 1970s.

  • The working class is evolving
  • The middle class is expanding
  • Youth aspirations are global

The Left still speaks the language of class struggle — but people increasingly speak the language of opportunity.

The Youth Question

The most silent shift is among young voters.

  • Where is the economic vision?
  • Where is innovation?
  • Where is the future beyond welfare?

The absence of compelling answers is slowly costing relevance.

Welfare Without Narrative Balance

Kerala’s welfare model remains strong and globally appreciated.

But the opposition successfully framed welfare as dependency, while development narratives did not gain equal force.

The Left delivered. But it did not define the meaning of what it delivered.

Organizational Rigidity

A communist party thrives on internal democracy combined with ideological discipline.

But when dissent is seen as indiscipline, the system weakens from within.

  • Leadership renewal slows down
  • New voices hesitate to emerge
  • Critical thinking declines

Vote Share: A Subtle but Serious Signal

The decline in vote share may appear small, but in Kerala’s tightly contested political landscape, even marginal shifts are decisive.

  • Core voters are not fully leaving
  • But they are no longer fully convinced
  • Opposition consolidation is becoming stronger

This is not rejection. This is a warning.

Cadre Morale and Emotional Disconnect

A movement survives on emotional energy.

Today, many cadres feel:

  • Less inspired
  • Less involved
  • Less heard

Without ideological enthusiasm at the grassroots, electoral machinery alone cannot sustain victory.

The Real Crisis: Ideological Drift

The deepest issue is not electoral loss — it is ideological uncertainty.

When a communist government becomes efficient in administration but weak in ideological clarity, it risks becoming indistinguishable from any other ruling structure.

The Way Forward: Reclaiming the Left

  • Rebuild grassroots engagement
  • Encourage internal criticism without fear
  • Bring forward new leadership
  • Balance welfare with development
  • Engage youth with future-oriented vision

People are not beneficiaries. They are participants.

Conclusion: A Moment to Listen

Kerala has not rejected the Left. It has asked the Left to reflect.

If the Left listens, it will evolve.
If it defends blindly, it will decline.

The choice is not electoral. It is historical.

ഇതേ കാര്യം കേരള ഹൈ കോടതി Rajesh v. State of Kerala
(2023 KHC 9993 ) , Karthika Pradeep v. State of Kerala (2025 KHC 2453 ) എന്ന കേസിലും വ്യാഖ്യാനിച്ചു . ഇത്തരത്തിൽ Crpc 91 / BNSS 94 പ്രകാരം നോട്ടീസ് നൽകുന്നത് പ്രതിയുടെ ഇന്ത്യൻ ഭരഘടനയിലെ ആർട്ടിക്കിൾ 20 (3) ന്റെ ലംഘനം ആണെന്ന് കണ്ടെത്തി .
ഇനി പ്രതി ഇപ്രകാരം മൊബൈൽ അല്ലെങ്കിൽ മറ്റു രേഖകൾ പോലിസിസിനു മുൻപാകെ ഹാജരാക്കിയില്ലെങ്കിൽ - അന്വേഷണവുമായി സഹകരിക്കുന്നില്ല എന്ന് പറഞ്ഞു ജാമ്യം റദ്ദ് ചെയ്യുവാൻ സാധിക്കുമോ ?
സുപ്രീം കോടതി Vinay Kumar Gupta v. ഇനി സ്വമേധയാ പോലീസ് സെർച്ച് നടത്തി ഇത്തരത്തിൽ ഉള്ള ഡിജിറ്റൽ ഡിവൈസുകൾ കണ്ടെത്തി സീസർ ചെയ്‌താൽ അതിന്റെ പാസ്സ്‌വേർഡ് പറഞ്ഞു കൊടുക്കേണ്ട കാര്യം പ്രതിക്ക് ഇല്ല .

WHEN MERITS REMAIN UNHEARD: REFLECTIONS ON ACCESS TO JUSTICE

It is a personal and academic reflection on procedural outcomes, access to justice, and structural challenges experienced by litigants within the justice delivery system. It does not question the integrity or independence of the judiciary, but examines systemic aspects that affect the accessibility and perception of justice.

Introduction

Access to justice is a foundational principle of constitutional governance. Courts, particularly constitutional courts, are entrusted with the responsibility of safeguarding rights and ensuring that legal remedies remain meaningful and effective. While the judiciary continues to uphold this mandate with integrity, it is equally important to reflect on how procedural mechanisms operate in practice and how they are experienced by litigants who approach the courts with genuine grievances.

This article seeks to examine the concept of access to justice from a litigant’s perspective, focusing on procedural barriers that may arise during the course of litigation. The discussion is intended not as criticism of individuals or institutions, but as an academic reflection on structural challenges within the justice delivery system.

The Litigant’s Expectation of Judicial Review

A litigant approaching a Court ordinarily does so with the expectation that the merits of the case will receive judicial consideration. Constitutional remedies, appellate jurisdiction, and supervisory powers are often perceived as safeguards against error and injustice. This expectation forms the basis of public confidence in the legal system.

When a matter is disposed of at a preliminary stage, the litigant may feel that substantive issues remain unaddressed. While such disposals are well within judicial discretion and procedural law, their impact on the litigant’s perception of justice deserves thoughtful examination.

Procedural Outcomes and Substantive Justice

Procedural law plays an essential role in ensuring efficiency, discipline, and fairness in judicial proceedings. However, an excessive reliance on procedural thresholds may sometimes overshadow substantive adjudication, particularly in cases involving individual litigants with limited resources.

Dismissals at the threshold, restrictions on maintainability, or strong procedural cautions can result in situations where grievances remain unresolved on merits. From a litigant’s standpoint, this can create a sense of finality without closure, raising broader questions about how procedural justice intersects with substantive justice.

Appellate Remedies and the Experience of Withdrawal

Appellate mechanisms exist to correct errors and reinforce confidence in judicial outcomes. Yet, the practical experience of pursuing appellate remedies can be daunting. Concerns relating to costs, procedural complexity, and the possibility of adverse consequences may weigh heavily on litigants.

In some instances, litigants may choose to withdraw proceedings not because their grievances lack substance, but due to apprehensions about prolonged litigation, financial exposure, or professional consequences. Such withdrawals, while procedurally valid, reflect the psychological and structural pressures inherent in the litigation process.

Power Imbalance in Litigation

Litigation does not occur in a vacuum. Disparities in resources, legal expertise, and institutional familiarity can significantly influence the experience of parties before the court. Individual litigants often find themselves at a disadvantage when opposed by parties with substantial resources and organizational strength.

This imbalance does not undermine the neutrality of the judicial process, but it does highlight the need for greater sensitivity towards the vulnerabilities of ordinary litigants. Access to justice must encompass not only formal availability of remedies but also the practical ability to pursue them without fear or undue hardship.

The Cost of Litigation as a Barrier to Access to Justice

An increasingly significant factor influencing access to justice is the rising cost of litigation. Court fees, expenses for legal representation, incidental costs, and the financial impact of prolonged proceedings can together impose substantial burdens on litigants. For individuals with limited resources, these economic pressures may deter the initiation of legal proceedings or compel the premature withdrawal of otherwise genuine claims.

The financial demands of litigation are often compounded by procedural delays. Extended timelines increase not only direct legal expenses but also indirect costs, such as loss of income, emotional strain, and opportunity costs. These cumulative effects can disproportionately affect individual litigants and small stakeholders, reinforcing existing inequalities within the justice delivery process.

While costs are an inevitable component of any legal system, their magnitude and unpredictability can influence perceptions of accessibility and fairness. The expectation of prolonged and expensive litigation may lead some litigants to seek informal settlements or to refrain from pursuing lawful remedies altogether. Such outcomes do not reflect a lack of faith in the rule of law, but rather practical concerns regarding affordability and sustainability.

Recognising the cost of litigation as a structural barrier underscores the importance of continued efforts to enhance legal aid mechanisms, promote procedural efficiency, and ensure that economic constraints do not undermine the constitutional promise of equal access to justice.

The Silent Litigant and Unheard Grievances

A significant number of litigants withdraw or abandon legal proceedings silently. Their experiences rarely enter legal discourse, yet they form an important part of the justice ecosystem. Fear of procedural consequences, reputational concerns, and the emotional toll of litigation often discourage continued pursuit of remedies.

This phenomenon calls for reflection on whether existing procedural frameworks sufficiently accommodate the realities faced by such litigants. Ensuring that justice is accessible requires attention to both legal doctrine and lived experience.

Beyond individual experiences, public discourse also plays a role in shaping perceptions of the justice delivery system. In recent years, sections of the media and public discourse have expressed concerns regarding judicial accountability, sometimes in highly emotive and adversarial terms. While such narratives reflect public anxiety, they underscore the importance of addressing perception gaps through institutional transparency rather than rhetoric. This highlights the need for balanced engagement with public concerns, ensuring that institutional responses strengthen confidence without compromising judicial independence.

Occasionally, public concern regarding judicial accountability is informed by reports of institutional action in response to alleged misconduct. For instance, mainstream media has reported cases where investigative agencies have initiated proceedings against former members of the judiciary, following prescribed constitutional and legal processes. Such reporting, when factual and restrained, contributes to public awareness while reinforcing the principle that accountability mechanisms exist within the system.

Towards Strengthening Confidence in Justice Delivery

Constructive introspection is a hallmark of strong institutions. Periodic reflection on procedural practices can help strengthen public confidence in the justice delivery system. Measures such as clearer articulation of reasons, litigant-friendly procedures, and enhanced legal aid mechanisms may contribute towards making justice more accessible and less intimidating.

Importantly, such reflections do not question the integrity or independence of the judiciary. Rather, they reaffirm respect for the institution by engaging with its continuous evolution.

Does Perceived Inaccessibility of Justice Contribute to Declining Public Confidence?

Scholars and criminologists have long examined the relationship between public confidence in justice delivery systems and social order. While it would be incorrect to attribute rising crime rates or extra-legal settlements to any single cause, studies suggest that perceived delays, costs, and procedural complexity in legal systems can influence public behavior, particularly among younger generations.

When individuals believe that formal legal remedies are inaccessible, excessively prolonged, or unlikely to result in timely relief, some may seek alternative means of dispute resolution. These may range from informal compromises and private settlements to, in extreme cases, recourse outside the bounds of law. Importantly, such behavior arises not necessarily from disregard for law, but from a perception that legal processes are impractical for addressing immediate grievances.

It must be emphasized that this perception does not reflect the intent or integrity of judicial institutions, but rather the experience of litigants navigating procedural realities. Socio-economic pressures, digital-era impatience, and exposure to rapid informal resolution mechanisms further amplify this trend among younger populations.

Criminological literature consistently holds that confidence in justice delivery acts as a stabilizing force in society. Where such confidence weakens—rightly or wrongly—there is an increased risk of disputes being resolved outside formal legal frameworks. This underscores the importance of strengthening not only the fairness of outcomes, but also the accessibility, transparency, and responsiveness of legal procedures.

International legal discourse has also recognised the relationship between corruption, human rights, and public confidence in judicial systems. The United Nations Special Rapporteur on the Independence of Judges and Lawyers has observed that corruption undermines the administration of justice by weakening public trust and impairing the judiciary’s capacity to protect human rights.

Accordingly, restoring faith in justice delivery requires continuous institutional introspection, procedural sensitivity, and meaningful engagement with the evolving expectations of society. Addressing perception gaps is as crucial as ensuring doctrinal correctness, for justice must not only be done, but must also be felt to be accessible.

Conclusion

Access to justice is not measured solely by the availability of courts or remedies, but by the extent to which those remedies remain practically reachable and meaningfully effective for those who seek them. Where grievances conclude without examination on merits, or where procedural and economic barriers influence the course of litigation, it becomes necessary to reflect on how justice is experienced at the ground level.

The issues discussed in this article - procedural thresholds, litigation costs, power imbalances, and the phenomenon of silent withdrawal - do not reflect a failure of judicial intent or integrity. Rather, they point to structural challenges inherent in a complex and evolving justice delivery system. Recognising these challenges is not an act of criticism, but an exercise in institutional self-awareness.

Public confidence in the judiciary is sustained not only by the fairness of outcomes, but also by transparency, accessibility, and the perception that genuine grievances receive due consideration. Addressing perception gaps through procedural clarity, affordability, and sensitivity to litigant realities strengthens, rather than diminishes, the authority of judicial institutions.

Ultimately, a justice system that remains open to introspection while steadfast in its independence reinforces its constitutional role as the guardian of rights and the rule of law. Meaningful access to justice ensures that faith in legal processes endures, and that justice is not only done, but is also felt to be attainable.

ഭാരതചരിത്രത്തിൽ ചില പേരുകൾ ഉണ്ട്. അവരെ ചോദ്യം ചെയ്യുന്നതുതന്നെ അശ്രദ്ധയായി കണക്കാക്കപ്പെടുന്ന പേരുകൾ. അശോകൻ അത്തരം ഒരാളാണ്. അങ്ങനെ ഇപ്പോൾ അശോകനെ കുറിച്ച് പറയുന്ന കഥയുടെ ഒരു വിശകലനം നോക്കാം, തികച്ചും എന്റെ അവലോകനം മാത്രം ആണ് ഇത്.. 

പാഠപുസ്തകങ്ങളിൽ അദ്ദേഹം കരുണയുടെ ചക്രവർത്തിയാണ്. സ്മാരകങ്ങളിൽ അദ്ദേഹം ധർമ്മത്തിന്റെ ശില്പിയാണ്. രാഷ്ട്രീയത്തിൽ അദ്ദേഹം സമാധാനത്തിന്റെ പ്രതീകമാണ്. എന്നാൽ ചരിത്രം ഇത്ര വൃത്തിയുള്ള ഒന്നല്ല. അത് രക്തക്കറകൾ മറച്ചുവെച്ച ഒരു എഴുത്താണ്.

അശോകൻ ഒരു കെട്ടുകഥയല്ല. അതുപോലെ ഒരു സന്യാസരാജാവുമല്ല.

അദ്ദേഹം ക്രൂരതയും രാഷ്ട്രീയ കണക്കുകൂട്ടലും മതവും ചേർന്നുണ്ടായ ഒരു ഭരണാധികാരിയാണ്. അദ്ദേഹത്തിന്റെ ചിത്രം ബൗദ്ധ സാഹിത്യവും ആധുനിക രാഷ്ട്രീയവും ചേർന്ന് മിനുക്കിയതാണ്.

അശോകൻ സിംഹാസനത്തിലേക്ക് നടന്നുകയറിയതല്ല. അത് പിടിച്ചെടുത്തതാണ്.

ബിന്ദുസാരന്റെ മരണത്തിന് ശേഷം നിയമപരമായ കിരീടാവകാശി സുഷീമയായിരുന്നു. സുഷീമ തലസ്ഥാനത്ത് ഇല്ലാത്ത സമയത്താണ് അശോകൻ അധികാരം ഉറപ്പിച്ചത്. സുഷീമയെ തീക്കനലിൽ കത്തിച്ചുവെന്ന കഥ ചരിത്രപരമായി തെളിയിക്കപ്പെട്ടിട്ടില്ല. പക്ഷേ അതിനേക്കാൾ പ്രധാനപ്പെട്ട കാര്യം ഇതാണ്: അധികാരം രക്തമൊഴിക്കാതെ അശോകന് കിട്ടിയില്ല.

ഇവിടെ അശോകൻ അസാധാരണമല്ല. അദ്ദേഹം രാജവംശ രാഷ്ട്രീയത്തിന്റെ സാധാരണ നിയമം മാത്രമാണ്.

99 സഹോദരന്മാർ: എണ്ണം സംശയാസ്പദം, സന്ദേശം വ്യക്തം

ബൗദ്ധ ഗ്രന്ഥങ്ങൾ പറയുന്നു: 99 അർദ്ധ സഹോദരന്മാർ കൊല്ലപ്പെട്ടു.

ഒരുപക്ഷേ 99 അല്ല; ഒരുപക്ഷേ കുറവായിരിക്കും, പക്ഷേ ഒരിക്കലും അത് പൂജ്യം ആയിരുന്നില്ല. രാജവംശ രാഷ്ട്രീയത്തിൽ, അധികാരം ഉറപ്പിച്ചാൽ എതിരാളികൾ ജീവിച്ചിരിക്കാറില്ല. അശോകൻ ഇതിൽ വ്യത്യസ്തനല്ല. പാഠപുസ്തകങ്ങൾ മറന്നത് ഇതാണ്.

ബൗദ്ധമതം: ആത്മീയ ഉണർവോ, കൃത്യമായ രാഷ്ട്രീയ നീക്കമോ? 

ഇവിടെയാണ് കഥയുടെ ദിശ മാറുന്നത്. ബിന്ദുസാരനും അദ്ദേഹത്തിന്റെ മന്ത്രിമാരും അജീവിക വിശ്വാസികളായിരുന്നു. അജീവികരും ബൗദ്ധരും തമ്മിൽ കടുത്ത സംഘർഷം നിലനിന്നിരുന്നു. അശോകൻ അധികാരം പിടിച്ചെങ്കിലും, അത് ന്യായീകരിക്കാൻ ഒരു സാമൂഹിക അടിത്തറ ആവശ്യമായിരുന്നു. അന്നത്തെ ബൗദ്ധമതം ഒരു ആത്മീയ പ്രസ്ഥാനം മാത്രമല്ലായിരുന്നു. അത് സംഘടിതമായിരുന്നു, സാമ്പത്തികമായി ശക്തമായിരുന്നു, അന്തർദേശീയ സ്വാധീനം പോലും ഉണ്ടായിരുന്നു. ഒരു ഭരണാധികാരി ഇതെല്ലാം കാണാതെ പോയി എന്ന് പറയുന്നത് ചരിത്രത്തെ അപമാനിക്കുന്നതാണ്. ഇവിടെ നടന്നത് ഒരു ബോധോദയം മാത്രമല്ല. അത് ഒരു സമയോചിതമായ സഖ്യമായിരുന്നു. 

രാജാവിന് ധാർമ്മിക മുഖം, സന്യാസിമാർക്ക് രാജകീയ സംരക്ഷണം.

ക്രൂരതകളുടെ കഥകൾ: എല്ലാം സത്യമല്ല, എല്ലാം കള്ളവും അല്ല

അശോകന്റെ നരകക്കൊട്ടാരം, ഇരുമ്പുകമ്പികൾ, ഉരുക്കിയ ചെമ്പ്, പതിനെട്ടായിരം അജീവികരുടെ കൂട്ടക്കൊല,  ഈ കഥകൾ ഞെട്ടിക്കും, പക്ഷേ ചരിത്രം ഞെട്ടലല്ല ചോദിക്കുന്നത്, തെളിവാണ്.

ഇവയിൽ പലതും ബൗദ്ധ സാഹിത്യത്തിൽ മാത്രമേ ഉള്ളൂ. അശോകന്റെ ശിലാലിഖിതങ്ങളിൽ അവ ഇല്ല. അതിനർത്ഥം: ക്രൂരതകൾ ഉണ്ടായിരിക്കാം. പക്ഷേ അവയുടെ രൂപവും വലുപ്പവും സാഹിത്യത്തിലൂടെ വളർത്തപ്പെട്ടതാണ്. 

ബൗദ്ധ സന്യാസിമാർ വെറും പാവങ്ങളായിരുന്നില്ല, അവർ നല്ല  എഴുത്തുകാരായിരുന്നു, അധികാരത്തിന്റെ സംരക്ഷണം കിട്ടിയ എഴുത്തുകാർ ചരിത്രം സ്വന്തം ഭാഷയിൽ എഴുതും. എക്കാലവും അതങ്ങനെ തന്നെ ആണല്ലോ !

ധർമ്മ മഹാമാത്രരെ “മത പൊലീസ്” എന്ന് വിളിക്കുന്നത് ഇന്നത്തെ കോപത്തിന്റെ ഭാഷയാണ്. അവർ നിരീക്ഷകരായിരുന്നു, നിയന്ത്രകരല്ല. അവർ അധികാരത്തിന്റെ നീളം തന്നെയായിരുന്നു, പക്ഷേ ഇന്നത്തെ ഉപമകൾ അതിനോട് നീതിയുള്ളതല്ല. ചരിത്ര രേഖകൾ പ്രകാരം അവർ: സാമൂഹ്യനീതി, തടവുകാരുടെ ക്ഷേമം, മതസഹിഷ്ണുത എന്നിവയ്ക്ക് ചുമതലപ്പെടുത്തിയ ഉദ്യോഗസ്ഥരായിരുന്നു.

👉 സൗദി മാതൃകയിലെ മത പൊലീസ് എന്ന താരതമ്യം ചരിത്രപരമായി നിലനിൽക്കില്ല.

ഇത് അശോകനെ വെളുപ്പിക്കുന്നില്ല. പക്ഷേ ചരിത്രത്തെ കൃത്രിമമായി കുറ്റപ്പെടുത്തുന്നതും ശരിയല്ല.

കലിംഗ യുദ്ധം അശോകനെ മാറ്റി എന്നത് അദ്ദേഹം തന്നെ സമ്മതിച്ച വസ്തുത ആണ്, പക്ഷേ മാറ്റം സാമ്രാജ്യം ഉപേക്ഷിക്കുന്നതുവരെ എത്തിയില്ല.

അശോകൻ യുദ്ധത്തിന്റെ വില തിരിച്ചറിഞ്ഞു. എന്നാൽ അധികാരം കൈവിട്ടില്ല. അദ്ദേഹം സന്യാസിയായില്ല. അദ്ദേഹം രാഷ്ട്രീയക്കാരനായി തുടർന്നു.

ആധുനിക ഇന്ത്യ: അശോകൻ എങ്ങനെ ഒരു ഐക്കണായി

കാലം കഴിഞ്ഞപ്പോൾ അശോകൻ വീണ്ടും കണ്ടെത്തപ്പെട്ടു. ബ്രിട്ടീഷുകാർ അശോകനെ “ധാർമ്മിക സാമ്രാജ്യ” മാതൃകയായി അവതരിപ്പിച്ചു, ബ്രിട്ടീഷുകാർക്ക് അദ്ദേഹം ഒരു മാതൃകാ രാജാവ്.  സ്വാതന്ത്ര്യാനന്തര ഇന്ത്യക്ക് അദ്ദേഹം സെക്യുലറിസത്തിന്റെയും സമാധാനത്തിന്റെയും ചിഹ്നം. ഇവിടെ കള്ളം പറഞ്ഞില്ല. പക്ഷേ അസൗകര്യകരമായ ഭാഗങ്ങൾ മൗനം പാലിച്ചു.

കോണ്ഗ്രസ്സ് സർക്കാറുകൾ അശോകനെ സൃഷ്ടിച്ചില്ല. അവർ അദ്ദേഹത്തെ തിരഞ്ഞെടുത്ത് അവതരിപ്പിച്ചു.

അങ്ങനെ അശോകൻ ഒരു മനുഷ്യനിൽ നിന്ന് ഒരു പോസ്റ്ററായി മാറി.

ചരിത്രം ആരാധനയ്ക്കുള്ളതല്ല. അത് വായനയ്ക്കും വിമർശനത്തിനും വേണ്ടിയാണ്.

ഈ എഴുത്തിന് കാരണം ആയത് താഴെ കാണുന്ന ഒരു ഫേസ്ബുക്ക് പ്രചരണം ആണ് ..

ഭാരത ചരിത്രത്തിലെ ഏറ്റവും വലിയ കള്ളങ്ങളിൽ ഒന്നാണ് അശോകൻ. ടിപ്പുവിന്റെ അത്ര വരില്ല എങ്കിലും തീരെ മോശമായിരുന്നില്ല അശോകനും. ബിന്ദുസാരന്റെ ശേഷം കിരീട അവകാശി സുഷീമ ആയിരുന്നു. യുവരാജാവ്‌ സുഷിമ രാജ്യത്തിന് പുറത്ത് ആയ സമയത്ത് ബിന്ദുസരൻ മരിച്ചു. ഇത് ഒരു അവസരമായി കണ്ട അശോകൻ തലസ്ഥാനമായ പാടലിപുത്രത്തിൽ എത്തി, അവിടം പിടിച്ചെടുക്കാൻ വേണ്ട വ്യവസ്ഥകൾ ചെയ്തു. ഇത്‌ ഗ്രീക്ക്‌ പടയാളികളുടെ സഹായത്തോടെ ആണ് എന്ന് രേഖകൾ പറയുന്നു. സുഷിമ എത്തും മുൻപ് അയാൾ കടന്നു വരേണ്ട ഗേറ്റിൽ തീക്കനൽ ഒരുക്കി മുകൾ വശം മണ്ണിട്ട് മൂടി കാത്തിരുന്നു. ആ തീയിൽ സുഷീമയെ അശോകൻ കത്തിച്ചു കൊന്ന് രാജ്യം പിടിച്ചു. രാജ്യഭരണത്തിന് പിന്നാലെ തന്റെ 99 അർദ്ധ സഹോദരന്മാരെയും അശോകൻ കൊന്നു എന്ന് മഹാവംശയും ദീപ വംശയും പറയുന്നു. അങ്ങനെ അധികാരം പിടിച്ച അശോകന്‌ പക്ഷെ ബിന്ദുസാരന്റെ മന്ത്രിമാരിൽ നിന്നും സഭയിലെ അംഗങ്ങളിൽ നിന്നും എതിർപ്പ്‌ നേരിടേണ്ടിവന്നു. അതിനുള്ള ഉത്തരവും അശോകന്റെ കയ്യിൽ ഉണ്ടായിരുന്നു. അങ്ങനെയുള്ള 500 പേരെ അശോകൻ സ്വയം വാളെടുത്ത് വെട്ടി കൊന്നു. ഇവിടെ മനസ്സിലാക്കേണ്ട ഒരു കാര്യം അശോകനെ ഭരണാധികാരി ആയി അംഗീകരിക്കാൻ ആരും തയ്യാറല്ലായിരുന്നു. ബിന്ദുസാരനും മന്ത്രിമാരും ഒക്കെ “അജീവിക” എന്ന ബുദ്ധ - ജൈന മതങ്ങൾക്ക് സമാന്തരമായി ഉയർന്നു വന്ന മത വിശ്വാസിയായിരുന്നു. അവരും ബൗദ്ധരും ഈ സമയത്ത് പരസ്പരം കടുത്ത സംഘടനങ്ങളിൽ ഏർപ്പെട്ടിരിക്കയായിരുന്നു. ഇത് ഒരു അവസരമായി കണ്ട അശോകൻ ബുദ്ധമതം സ്വീകരിച്ചു; രാജ്യം ബുദ്ധ രാജ്യമാക്കി. ഇതോടെ പണക്കാരായ ബുദ്ധ വൈശ്യർ കൂടെ ആയി. ഗീബൽസിയൻ പ്രോപഗണ്ട തന്നെ ആദ്യം കണ്ടുപിടിച്ചത് ബുദ്ധ സന്യാസിമാരാണ്. അവർ അതോടെ അശോകനെ എഴുതി വെളുപ്പിക്കാൻ തുടങ്ങി(ഈ വെളുപ്പിക്കലിന്റെ ഭാഗമായാണ് കൊലപാതകങ്ങൾ ഒക്കെ എഴുതി വച്ചതും). അശോകൻ ഒരു ദയയും ഇല്ലാതെ ശത്രുക്കളെ നേരിട്ടു. പീഡിപ്പിക്കാൻ വേണ്ടി ഒരു കൊട്ടാരം തന്നെ കെട്ടി അശോകൻ. സ്വന്തം മാതാപിതാക്കളെ വെട്ടിക്കൊന്ന ഗിരിക എന്നൊരുത്തനെ ഇത് ഏൽപ്പിച്ചു(റഫറൻസ് 1). കയ്യിലും കാലിലും പിന്നെ ഹൃദയത്തിലും ഇരുമ്പ് കമ്പികൾ കുത്തി കയറ്റുക, വായിൽ ഉരുക്കിയ ചെമ്പ് ഒഴിക്കുക, ഒരു വലിയ അരകല്ലിൽ ഇട്ട് അരയ്ക്കുക തുടങ്ങിയ രീതിയിലുള്ള പീഡനങ്ങൾ ആയിരുന്നു മഹാനായ അശോകന്റെ ഹോബി.ചരിത്രത്തിലെ ആദ്യ “മത പൊലീസ്” തുടങ്ങിയത് സൗദി അറേബ്യ ഒന്നും അല്ല. അശോകനാണ്. ബുദ്ധ നിയമങ്ങൾ ആളുകൾ അനുസരിക്കുന്നോ എന്ന് അറിയാൻ “ധർമ്മ മഹാമത്ര” എന്ന മത പൊലീസ് തുടങ്ങി. സമാജ എന്നറിയപ്പെട്ടിരുന്ന മേളകൾ നിരോധിച്ചു, അങ്ങനെ ഇരിക്കെ പുണ്ഡ്രവർദ്ധന എന്ന സ്ഥലത്ത്(ബംഗാൾ) ഒരു അജീവകൻ ഒരു ചിത്രം വരച്ചു, ബുദ്ധൻ അജീവകരുടെ ആചാര്യനായ ഗോശാലന്റെ കാൽചുവട്ടിൽ ഇരിക്കുന്ന ചിത്രം. ഇതിൽ ക്ഷോഭിച്ച അശോകൻ മുഴുവൻ അജീവകൻമാരെയും കൊല്ലാൻ ഉത്തരവിട്ടു. അന്ന് ഒരു ദിവസം 18000 അജീവകരെ കൊന്നു എന്ന് ബുദ്ധ ഗ്രന്ഥങ്ങൾ എഴുതിയിട്ടുണ്ട്. ഇതിന് സമാനമായ സംഭവം ജൈനൻമാരോടും അശോകൻ ചെയ്തു. അവരുടെ തല വെട്ടി കൊണ്ട് വരുന്നവർക്ക് വൻ തുക വാഗ്ദാനം ചെയ്തു. എന്തായാലും അബദ്ധത്തിൽ അശോകന്റെ ബാക്കിയുള്ള ഒരു സഹോദരൻ ഇങ്ങനെ കൊല്ലപ്പെടുകയും അയാൾ അത് നിർത്തുകയും ചെയ്തു. കലിംഗ യുദ്ധത്തിലേക്ക് വന്നാൽ ബുദ്ധമതക്കാരനായി വർഷങ്ങൾ കഴിഞ്ഞാണ് കലിംഗയുദ്ധം തുടങ്ങുന്നത് തന്നെ. അതായത് ലക്ഷക്കണക്കിന് ആളുകളെ കലിംഗത്തിൽ കൊന്നൊടുക്കിയ ബൗദ്ധനായ അശോകനാണ്. ഇതോടെ മാനസാന്തരം വന്നു എന്നതും തെറ്റാണ്. അങ്ങനെ എന്തെങ്കിലും രീതിയിൽ ക്ഷമാപണം അശോകൻ നടത്തിയതായി യാതൊരു തെളിവും ഇല്ല. മാത്രവുമല്ല അശോകൻ സൈന്യത്തെ തുടർന്നും നിലനിർത്തി. പക്ഷേ അശോകന് വേണ്ടി ബുദ്ധ സന്യാസിമാർ നല്ല പണി എടുത്തു; അവർ പറ്റുന്ന ഇടങ്ങളിൽ ഒക്കെ അശോകനെ വെളുപ്പിച്ച സ്തൂപങ്ങൾ സ്ഥാപിച്ചു. ഇനി ആധുനിക കാലഘട്ടത്തിലേക്ക് വന്നാൽ ബ്രിട്ടീഷുകാർ അധികാരത്തിൽ വരുമ്പോഴേക്കും ഹിന്ദുക്കൾ തിരികെ അധികാരം പിടിച്ചിരുന്നു; അശോകനെ ആരും ഓർക്കാതെയായി. പക്ഷേ സമാധാനത്തിന് വേണ്ടി ബുദ്ധമതം സ്വീകരിച്ച അശോകൻ ബ്രിട്ടീഷുകാർക്ക് നല്ല ഒരു ഐഡിയ ആയി തോന്നി. പിന്നാലെ സ്വാതന്ത്ര്യത്തിന് ശേഷം അശോകന്റെ യഥാർഥ ചരിത്രം അറിയാത്ത നെഹ്റു അടക്കം പലരും ചേർന്ന് അശോകനെ ഹീറോ ആക്കി! അതേ അശോകനും ഒരു ചെറിയ ടിപ്പു ആയിരുന്നു. ചന്ദ്ര ഗുപ്ത മൗര്യനോ ബിന്ദുസരനോ ഒക്കെ യുദ്ധവും ക്രൂരതകളും ചെയ്തിട്ടുണ്ട്, പക്ഷേ അവരാരും മത വെറി പൂണ്ട് കൊന്നൊടുക്കിയിട്ടില്ല. അതേ, ബുദ്ധ സന്യാസിമാർ പാവങ്ങൾ ആയിരുന്നു എന്നോ മറ്റോ ആണ് നിങ്ങൾ പഠിച്ചത് എങ്കിൽ, അശോകൻ മഹാനാണ് എന്നാണ് പഠിച്ചത് എങ്കിൽ, അത് വെറും പ്രോപഗണ്ട ആണ്.

Introduction 

A Malayali Whose Smile Crossed Oceans
In the vast tapestry of Indian emigrant stories, there are many tales of struggle and survival. Yet few are as heart-warming, globally resonant, and universally admired as the life of Kottarapattu Chattu Kuttan  affectionately known around the world simply as Mr. Kuttan. A young boy who left his home in Thrissur, Kerala, in 1938 with just ₹25 and a dream, Mr. Kuttan would go on to become one of the most recognizable and beloved figures in global hospitality — a man whose presence became the symbol of Sri Lanka’s historic Galle Face Hotel and a living embodiment of gracious service that welcomed visitors from every corner of the world. 
This is not merely a story about a hotel doorman. This is the story of a Malayali whose warmth, humility, and dignity transformed him into an international icon of hospitality — a man whom millions of guests remembered long after leaving the shores of Sri Lanka.

The Early Years - From Thrissur to the Shores of Ceylon
Born on 15 February 1920 in Thrissur district of Kerala, Kuttan lost his parents early in life. With no road map and little more than 25 rupees in his pocket, he made a life-altering decision at the age of 18: to leave his homeland and seek a future beyond the seas. With courage in his heart, he walked to the port city of Talaimannar on Sri Lanka’s northern coast and entered what was then called Ceylon. 
It was 1938 — a time when the world was on the brink of monumental change, and India was still under colonial rule. Yet Kuttan’s journey was not one of political upheaval. Rather, it was a deeply personal quest for dignity, purpose, and survival in a land that was both foreign and full of possibility. Legend says he possessed nothing more than the clothes on his back and a silent determination to carve a life of respect for himself through honest work. 
In his early years in Colombo, he worked as a domestic servant in elite households, learning the nuances of service and human engagement that would later define his life’s purpose. 

A Remarkable Career Begins - Entering Galle Face Hotel
In 1942, at the height of World War II and long before India’s independence, Kuttan joined the Galle Face Hotel in Colombo - one of the oldest hotels in Asia, established in 1864 and regarded as an institution in luxury and travel. 
He began humbly as a waiter, a role that involved serving meals and attending to guests with the meticulous attention that would soon make him unforgettable. 
His personality and demeanor were noticed quickly. From waiter, he became a bellboy, carrying luggage and guiding guests through the early stages of their stay. Eventually, he took on the role that would define his legacy — doorman. 
As a doorman, Kuttan did much more than open doors. With folded hands, a gentle bow, direct eye contact, and the traditional Sri Lankan greeting “Ayubowan” (meaning “long life”), he welcomed every visitor — from first-time travelers to kings, presidents, and Nobel laureates. His approachable demeanor made everyone feel not just welcomed, but seen, respected, and valued. 

Hospitality Beyond Job Description - What Made Mr. Kuttan So Beloved?
To many, a hotel doorman is a functionary role — a position that welcomes and moves on. But in the 72 years that Kuttan served at the Galle Face Hotel, he elevated his role into an art form of human engagement - a daily practice of hospitality that was genuine, personal, and deeply human.
Travel commentators and guests alike would later describe him this way:
 “Mr. Kuttan didn’t just open the doors - he opened hearts. His smile was more than a gesture; it was an invitation to feel at home, no matter where you had come from.” 
His distinguishing look - a small frame, white hair, a handlebar mustache, and a uniform always pristine - became a treasured image for returning and new visitors. His photograph adorned the covers of travel magazines around the world, from East to West, showcasing a figure that travel writers called the human face of Sri Lanka’s hospitality legacy. 
One travel blog from late 2014 sums up the experience beautifully:
 “Kuttan would greet every arriving car. Palms pressed together, a slight bow, guiding guests to the lobby, and all this without uttering a word in English — yet his warmth was universally understood.”

For the Galle Face Hotel, Kuttan was not just an employee; he was part of the very identity and heritage of the institution. Even after his passing, his image continues to represent the hotel — today used as the avatar for the hotel’s website chat feature — a tribute to the man whose presence was synonymous with welcome itself. 
What makes this even more remarkable is the length of his service. From 1942 until his death in 2014, Kuttan worked — 72 uninterrupted years — at the same hotel in the same role, serving countless guests with unwavering dedication.

ആകാശത്തിലെ ശവപ്പെട്ടി (The Coffin in the Sky)

 1958 ഡിസംബർ 4. രാത്രി 11 pm 
ഭൂമിയിൽ നിന്ന് നോക്കുമ്പോൾ അതൊരു മനോഹരമായ കാഴ്ചയായിരുന്നു. നക്ഷത്രങ്ങൾക്കിടയിലൂടെ നീങ്ങുന്ന ഒരു കുഞ്ഞു വെളിച്ചം. പക്ഷേ, ആ വെളിച്ചത്തിനുള്ളിൽ ഒരു നരകം ഉണ്ടായിരുന്നു . 

"സെസ്‌ന 172 "എന്ന ആ വിമാനത്തിന് റോബർട്ട് ടിം പേരിട്ടത്
 'ഹസീൻഡ' എന്നായിരുന്നു. 

പക്ഷേ ആകാശത്തേക്ക് ഉയർന്ന് ആദ്യത്തെ 48 മണിക്കൂർ പിന്നിട്ടപ്പോൾ ജോൺ കുക്കിന് തോന്നി തുടങ്ങിയത് അതൊരു വിമാനമല്ല, മറിച്ച് പറക്കുന്ന ഒരു 'ഉരുക്ക് ശവപ്പെട്ടി' (Steel Coffin) ആണെന്നാണ്.

വിമാനത്തിനുള്ളിലെ ശബ്ദം... അതായിരുന്നു ആദ്യത്തെ വില്ലൻ. എഞ്ചിന്റെ കാതടപ്പിക്കുന്ന ഇരമ്പൽ. ആയിരം കടന്നലുകൾ തലച്ചോറിനുള്ളിൽ ഇരുന്ന് മൂളുന്നതുപോലെയുള്ള ശബ്ദം. പരസ്പരം സംസാരിക്കാൻ പോലും അവർക്ക് അലറണമായിരുന്നു. വിമാനത്തിന്റെ പിൻഭാഗത്തെ സീറ്റുകൾ എടുത്തുമാറ്റി അവിടെ വെറുമൊരു ഫോം മെത്തയാണ് ഇട്ടിരിക്കുന്നത്. നാലടി നീളം പോലുമില്ലാത്ത ഒരു ഇടം. അവിടെയാണ് ഒരാൾ ചുരുണ്ടുകൂടി കിടക്കേണ്ടത്.

"നമ്മൾ മുകളിലെത്തി ജോൺ... ഇനി താഴെ മരുഭൂമി മാത്രം," 

റോബർട്ട് ടിം കോക്പിറ്റിലിരുന്ന് വിളിച്ചു പറഞ്ഞു.

പക്ഷേ ജോൺ കുക്കിന്റെ കണ്ണുകൾ താഴെ പരന്നുകിടക്കുന്ന നെവാഡ മരുഭൂമിയിലെ കൂരിരുട്ടിലായിരുന്നു. ആ ഇരുട്ടിന് വല്ലാത്തൊരു ആഴമുണ്ടായിരുന്നു. താഴെ വീണാൽ ആരും അറിയില്ല. കത്തിക്കരിഞ്ഞ മാംസക്കഷ്ണങ്ങൾ തേടി കഴുകന്മാർ വരാൻ പോലും ദിവസങ്ങളെടുക്കും.

ആദ്യത്തെ രാത്രി ഏറ്റവും ഭീകരമായിരുന്നു. വിമാനത്തിന്റെ ചെറിയ ജനാലയിലൂടെ പുറത്തേക്ക് നോക്കിയാൽ ശൂന്യത മാത്രം. ഒരു നിമിഷം എഞ്ചിൻ ഒന്ന് നിർത്തിയാലോ എന്ന ഭ്രാന്തൻ ചിന്ത കുക്കിന്റെ മനസ്സിലൂടെ മിന്നിമറഞ്ഞു. പിന്നീട് എങ്ങനെയോ അയാൾ അതിൽ നിന്ന് വഴുതിമാറി 

വായുവിൽ എപ്പോഴും വിമാനത്തിൻറെ ഇന്ധനത്തിന്റെ ഗന്ധം കലർന്നിരുന്നു. ആ ഗന്ധം അവരുടെ ശ്വാസകോശങ്ങളിൽ പറ്റിപ്പിടിച്ചു. വരാനിരിക്കുന്ന 64 ദിവസങ്ങൾക്കുള്ളിൽ ഈ ഗന്ധം അവരുടെ രക്തത്തിൽ വരെ അലിഞ്ഞുചേരുമെന്ന് അപ്പോൾ അവർ അറിഞ്ഞിരുന്നില്ല.

വിമാനത്തിന്റെ തറയിലൂടെ ഒരു വിറയൽ പാദങ്ങളിലേക്ക് അരിച്ചു കയറുന്നുണ്ട്. അത് എഞ്ചിന്റെ വിറയലല്ല, മരണം അതിൻറെ പടി വാതിലിൽ മുട്ടുന്ന ശബ്ദമാണ്. ആകാശത്തിലെ ഏകാന്തതയിലേക്ക് അവർ ക്രമേണ വഴുതി വീഴുകയായിരുന്നു.

ദിവസം: 12.
ഇന്ധനം തീരുന്നു. ഫ്യൂവൽ ഗേജിലെ സൂചി ചുവന്ന വരയിലേക്ക് താഴുന്നു. സാധാരണ ഗതിയിൽ ഇതൊരു പൈലറ്റിന്റെ ഏറ്റവും വലിയ പേടിസ്വപ്നമാണ്. പക്ഷേ ഇവർക്ക് അതൊരു ദിനചര്യയാണ്. ഒരു മരണക്കളി.

"താഴേക്ക് പോകൂ... അവരുണ്ട്," കുക്ക് അലറി.

താഴെ, ഹൈവേ 99-ലൂടെ ഒരു ഫോർഡ് ട്രക്ക് ചീറിപ്പായുന്നുണ്ട്. മരുഭൂമിയിലെ പൊടിക്കാറ്റിൽ ആ ട്രക്ക് ഒരു ചെറിയ കറുത്ത പൊട്ടുപോലെ കാണപ്പെട്ടു. ടിം വിമാനത്തിന്റെ മൂക്ക് കുത്തനെ താഴേക്ക് തിരിച്ചു. ഗ്രാവിറ്റി നെഞ്ചിലേക്ക് അമരുന്ന അനുഭവം. വിമാനം മരുഭൂമിയിലെ റോഡിന് സമാന്തരമായി, വെറും 20 അടി ഉയരത്തിൽ പറക്കാൻ തുടങ്ങി.

ഇതൊരു ആത്മഹത്യാപരമായ നീക്കമാണ്. റോഡിലെ ചെറിയൊരു കല്ല്, അല്ലെങ്കിൽ പെട്ടെന്നുള്ള ഒരു കാറ്റ്... വിമാനം റോഡിൽ ഇടിച്ചിറങ്ങും. പ്രൊപ്പല്ലർ ബ്ലേഡുകൾ ട്രക്കിന്റെ മുകൾഭാഗം വെട്ടിപ്പൊളിക്കും. മാംസവും ലോഹവും കൂടിക്കുഴഞ്ഞ ഒരു ചട്നിയായി അവർ മാറും.

ജോൺ കുക്ക് വിമാനത്തിന്റെ വാതിൽ തുറന്നു. കാറ്റ് ഒരു രാക്ഷസനെപ്പോലെ ഉള്ളിലേക്ക് ഇരച്ചുകയറി. താഴെ ട്രക്കിൽ നിന്ന് ഒരാൾ മുകളിലേക്ക് നോക്കുന്നുണ്ട്. അയാളുടെ മുഖത്തെ ഭയം കുക്കിന് വ്യക്തമായി കാണാം. ട്രക്കിന്റെ വേഗതയും വിമാനത്തിന്റെ വേഗതയും തുല്യമാകണം (Synchronization). ഒരല്പം പിഴച്ചാൽ മരണം ഉറപ്പ്.
ട്രക്കിൽ നിന്ന് ഒരു ഹോസ് (Hose) മുകളിലേക്ക് എറിഞ്ഞു. കുക്ക് പാതി ശരീരം പുറത്തേക്കിട്ട് ആ ഹോസ് പിടിച്ചെടുത്തു. വിമാനത്തിന്റെ ഇന്ധന ടാങ്കിലേക്ക് അത് ഘടിപ്പിച്ചു. 

ആ നിമിഷം... വിമാനത്തിനും ട്രക്കിനും ഇടയിൽ ആ റബ്ബർ പൈപ്പ് ഒരു പൊക്കിൾക്കൊടി പോലെയായി.
ഇന്ധനം മുകളിലേക്ക് പമ്പ് ചെയ്യപ്പെടുന്നു. പെട്ടെന്നൊരു കാറ്റ് വീശി. വിമാനം ഒന്ന് ഉലഞ്ഞു.

"ജോൺ! മുറുകെ പിടിച്ചോ!" ടിമ്മിന്റെ അലർച്ച.

വിമാനം വലത്തോട്ട് ചരിഞ്ഞു. കുക്ക് തെറിച്ചു പോകാതിരിക്കാൻ സീറ്റിന്റെ കാലിൽ കാലുകൾ കൊരുത്തിട്ടു. 

ഇന്ധനം കുറച്ചു പുറത്തേക്ക് തെറിച്ചു. അത് കാറ്റിൽ പറന്ന് കുക്കിന്റെ മുഖത്തും കണ്ണിലും വീണു. കണ്ണിനുള്ളിൽ നീറുന്നു. കാഴ്ച മങ്ങുന്നു. പക്ഷേ പിടി വിട്ടാൽ ആ ഹോസ് പ്രൊപ്പല്ലറിൽ കുരുങ്ങും. വിമാനം കത്തും.

മൂന്ന് മിനിറ്റ്. നരകതുല്യമായ മൂന്ന് മിനിറ്റ്. ഒടുവിൽ ടാങ്ക് നിറഞ്ഞു. ഒപ്പം അവർക്കുള്ള ഭക്ഷണവും എത്തി ..ഹോസ് താഴേക്ക് ഇട്ടു. വിമാനം വീണ്ടും ആകാശത്തിന്റെ സുരക്ഷിതത്വമില്ലായ്മയിലേക്ക് ഉയർന്നു.

 കുക്ക് തന്റെ ഇന്ധനം മണക്കുന്ന കൈകളിലേക്ക് നോക്കി. വിറയൽ മാറാൻ മണിക്കൂറുകൾ എടുത്തു. ഇത് ഇനിയും 120 തവണ കൂടി ആവർത്തിക്കണമായിരുന്നു.

ദിവസം: 35. പാതിരാത്രി.
ഉറക്കം... അതൊരു ആഡംബരമായിരുന്നു. മനുഷ്യന് ഭ്രാന്ത് പിടിക്കാൻ ഏറ്റവും എളുപ്പമുള്ള വഴി അവന് ഉറക്കം നിഷേധിക്കുക എന്നതാണ്. 35 ദിവസമായി അവർ ശരിയായി ഉറങ്ങിയിട്ട്. ശരീരം തളർന്നു, പക്ഷേ മനസ്സ് ഉണർന്നിരുന്നു, അനാവശ്യമായ ചിന്തകളുമായി.

 വിമാനത്തിൻ്റെ ഓട്ടോപൈലറ്റ് (Autopilot) എന്ന യന്ത്രം പണിമുടക്കിയിരിക്കുന്നു. 
ഇനി ഓരോ നിമിഷവും വിമാനം കൈകൾ കൊണ്ട് നിയന്ത്രിക്കണം. ഒരാൾ ഉറങ്ങുമ്പോൾ മറ്റേയാൾ ഉണർന്നിരിക്കണം. പക്ഷേ ക്ഷീണം കൊണ്ട് കണ്ണ് ചിമ്മുന്ന ആ ഒരു നിമിഷം വിമാനം വട്ടം കറങ്ങാൻ തുടങ്ങും.

അന്നത്തെ രാത്രി ആകാശത്തിന് വല്ലാത്തൊരു കറുപ്പായിരുന്നു. റോബർട്ട് ടിം വിമാനം പറത്തുകയാണ്. ജോൺ കുക്ക് പിന്നിലെ മെത്തയിൽ മയങ്ങുന്നു. പെട്ടെന്ന് ടിം കോക്പിറ്റിലെ ഗ്ലാസിലൂടെ പുറത്തേക്ക് നോക്കി. അവിടെ...ദൂരെ മേഘങ്ങൾക്കിടയിൽ... ഒരാൾ നടക്കുന്നു!
ടിം ഞെട്ടിവിറച്ചു. കണ്ണുകൾ തിരുമ്മി. വീണ്ടും നോക്കി. "

അതാ, ചിറകില്ലാത്ത ഒരു മനുഷ്യരൂപം വിമാനത്തിന് ഒപ്പം പറക്കുന്നു"
. ടിം അലറിവിളിച്ചു. കുക്ക് ഞെട്ടിയുണർന്നു.

"എന്താ? എന്തുപറ്റി?"

"അവിടെ... അവിടെ ആരോ ഉണ്ട്!" ടിം വിരൽ ചൂണ്ടി.

കുക്ക് പുറത്തേക്ക് നോക്കി. ശൂന്യത മാത്രം.

"അവിടെ ഒന്നുമില്ല റോബർട്ട്. അത് നിന്റെ തോന്നലാണ്. ഹാലുസിനേഷൻ (Hallucination)!"

"അല്ല! ഞാൻ കണ്ടു. അവൻ എന്നെ നോക്കി ചിരിച്ചു!" ടിമ്മിന്റെ ശബ്ദം ഇടറുന്നുണ്ടായിരുന്നു.

അവർക്ക് ഭ്രാന്ത് പിടിച്ചു തുടങ്ങിയിരുന്നു. തലച്ചോറ് യാഥാർത്ഥ്യവും തോന്നലുകളും തമ്മിലുള്ള വേർതിരിവ് നഷ്ടപ്പെടുത്തിയിരിക്കുന്നു. 

മറ്റൊരു രാത്രിയിൽ കുക്ക് വിചാരിച്ചത് വിമാനം ഒരു വലിയ മതിലിലേക്ക് ഇടിക്കാൻ പോകുന്നു എന്നാണ്. അയാൾ ഭയന്ന് വിമാനം വെട്ടിത്തിരിച്ചു. യഥാർത്ഥത്തിൽ അവിടെ ആകാശം മാത്രമേ ഉണ്ടായിരുന്നുള്ളൂ.

ആകാശത്തിലെ ഏകാന്തത അവരെ കാർന്നുതിന്നാൻ തുടങ്ങി. താഴെ ഭൂമിയിലുള്ള മനുഷ്യർ, അവരുടെ വീടുകൾ, വിളക്കുകൾ... എല്ലാം അന്യഗ്രഹജീവികളുടെ ലോകം പോലെ അവർക്ക് തോന്നി. 

അവർ രണ്ട് പേർ മാത്രം, ഈ അനന്തമായ ശൂന്യതയിൽ, ഒരു യന്ത്രത്തിനുള്ളിൽ തടവിലാക്കപ്പെട്ട ജന്മങ്ങൾ. പരസ്പരം മിണ്ടാൻ പോലും അവർക്ക് ഭയമായി. കാരണം, പുറത്തു വരുന്ന വാക്കുകൾക്ക് അർത്ഥമുണ്ടാകില്ലെന്ന് അവർ ഭയന്നു

ദിവസം: 50.
വിമാനത്തിനുള്ളിലെ വായുവിന് ഇപ്പോൾ ശവപ്പറമ്പിലെ ഗന്ധമാണ്.
കുളിച്ചിട്ട് 50 ദിവസങ്ങൾ. വിയർപ്പ്, എണ്ണ, പെട്രോൾ, വിസർജ്ജ്യങ്ങൾ എന്നിവയുടെ ഗന്ധം ആ ചെറിയ ക്യാബിനിൽ തളംകെട്ടി നിൽക്കുന്നു. 

പല്ലുതേച്ചിട്ടില്ല, വസ്ത്രം മാറിയിട്ടില്ല. തൊലിപ്പുറത്ത് വ്രണങ്ങൾ വന്നുതുടങ്ങി. ചൊറിച്ചിൽ സഹിക്കാനാവുന്നില്ല.
പക്ഷേ അതിനേക്കാൾ ഭീകരമായിരുന്നു വിമാനത്തിന്റെ അവസ്ഥ. 

ആ പാവം സെസ്‌ന 172 ജീർണ്ണിച്ചു തുടങ്ങിയിരുന്നു. സ്പാർക്ക് പ്ലഗുകളിൽ (Spark Plugs) കാർബൺ അടിഞ്ഞുകൂടിയിരിക്കുന്നു. എഞ്ചിന്റെ താളം തെറ്റിത്തുടങ്ങി. ഓരോ തവണ പിസ്റ്റൺ ചലിക്കുമ്പോഴും എഞ്ചിൻ വേദനയോടെ ഞരങ്ങുന്നതുപോലെ തോന്നി.

"ഇതിന് ഇനി അധികം ആയുസ്സില്ല ജോൺ," ടിം നിരാശയോടെ പറഞ്ഞു.

എഞ്ചിന്റെ കരുത്ത് കുറയുന്നു. വിമാനം പഴയതുപോലെ ഉയരത്തിലേക്ക് കയറുന്നില്ല. ഫുൾ ത്രോട്ടിൽ കൊടുത്താലും അത് കിതയ്ക്കുന്നു. മരുഭൂമിയിലെ മലനിരകൾക്ക് മുകളിലൂടെ പറക്കുമ്പോൾ, വിമാനം മലമുകളിൽ തട്ടുമോ എന്ന് അവർ ഭയന്നു.
ഒരു രാത്രിയിൽ, ജനറേറ്റർ തകരാറിലായി. കോക്പിറ്റിലെ ലൈറ്റുകൾ എല്ലാം അണഞ്ഞു. കൂരിരുട്ട്. ഡാഷ്ബോർഡിലെ മീറ്ററുകൾ കാണാൻ ടോർച്ച് അടിക്കണം. ഹീറ്റർ പ്രവർത്തിക്കുന്നില്ല. മരുഭൂമിയിലെ രാത്രിക്ക് എല്ലുറയുന്ന തണുപ്പാണ്. കമ്പിളികൾക്കുള്ളിൽ ചുരുണ്ടുകൂടിയിട്ടും അവരുടെ പല്ലുകൾ കൂട്ടിയിടിച്ചു. തണുപ്പും വിശപ്പും ക്ഷീണവും...

ഏറ്റവും അറപ്പുളവാക്കുന്ന കാര്യം വിസർജ്ജനമായിരുന്നു. പ്ലാസ്റ്റിക് കവറുകളിൽ മലമൂത്രവിസർജ്ജനം നടത്തി അത് ജനലിലൂടെ പുറത്തേക്ക് എറിയണം. പലപ്പോഴും കാറ്റിൽ അത് തിരിച്ച് വിമാനത്തിന്റെ വശങ്ങളിൽ തന്നെ വന്ന് അടിക്കും. ആ നാറ്റത്തിൽ ഇരുന്ന് ഭക്ഷണം കഴിക്കാൻ പോലും അവർക്ക് അറപ്പുതോന്നി. വിശപ്പ് കെട്ടടങ്ങി. ശരീരത്തിലെ മാംസം ഉരുകിത്തീർന്നു. കണ്ണുകൾ കുഴിയിലായി. അവർ ജീവനുള്ള അസ്ഥികൂടങ്ങളായി മാറിക്കഴിഞ്ഞിരുന്നു.

"നമുക്ക് നിർത്താം... പ്ലീസ്," കുക്ക് പലവട്ടം പറഞ്ഞു.

പക്ഷേ ടിമ്മിന്റെ കണ്ണുകളിൽ ഒരു വന്യമായ തിളക്കമുണ്ടായിരുന്നു. 
"ഇല്ല... മരിച്ചാലും താഴെ ഇറങ്ങില്ല. റെക്കോർഡ്... അതൊന്നു മാത്രമാണ് ലക്ഷ്യം."

 65 ആം ദിവസം . ഫെബ്രുവരി 7, 1959.

അവസാനം ആ തീരുമാനം അവർ എടുത്തു. ഇറങ്ങാം.
പക്ഷേ അതൊരു ആഘോഷമായിരുന്നില്ല. തോൽവിയുമല്ല. വെറും കീഴടങ്ങൽ മാത്രം. എഞ്ചിൻ ഏത് നിമിഷവും പൊട്ടിത്തെറിക്കാം എന്ന അവസ്ഥയിലാണ്. സ്പാർക്ക് പ്ലഗുകൾ പൂർണ്ണമായും കരിപിടിച്ചു പോയി.

ലാസ് വെഗാസിലെ മക്കറൻ ഫീൽഡ് ദൂരെ കണ്ടു. 65 ദിവസങ്ങൾക്ക് ശേഷം ഭൂമിയെ തൊടാൻ പോകുന്നു. പക്ഷേ അവർക്ക് സന്തോഷമുണ്ടായിരുന്നില്ല. മനസ്സിൽ ഒരു മരവിപ്പ് മാത്രം.

ടിം ലാൻഡിംഗ് ഗിയർ താഴ്ത്തി. ചക്രങ്ങൾ ലോക്ക് ആയോ എന്ന് പോലും ഉറപ്പില്ല. വിമാനം റൺവേയിലേക്ക് അടുത്തു. ഭൂമി അവരെ വിഴുങ്ങാൻ വായ പിളർന്നു നിൽക്കുന്നതുപോലെ തോന്നി.

തൊട്ടു!
ചക്രങ്ങൾ റൺവേയിൽ ഉരസിയപ്പോൾ ഉണ്ടായ ആ ചെറിയ കുലുക്കം... അതൊരു ഇടിമുഴക്കം പോലെയാണ് അവർക്ക് അനുഭവപ്പെട്ടത്. വിമാനം നിന്നു.
എഞ്ചിൻ ഓഫ് ചെയ്തു.

പെട്ടെന്ന്... ലോകം നിശബ്ദമായി. 64 ദിവസവും 22 മണിക്കൂറും 19 മിനിറ്റും തുടർച്ചയായി കേട്ടുകൊണ്ടിരുന്ന ആ ഇരമ്പൽ നിലച്ചു. ആ നിശബ്ദത അവരെ ഭ്രാന്ത് പിടിപ്പിക്കുന്നതായിരുന്നു. ചെവികൾക്കുള്ളിൽ ഇപ്പോഴും എഞ്ചിന്റെ മൂളലുണ്ട്.
വാതിൽ തുറന്നു. പുറത്ത് ആളുകൾ ഓടിക്കൂടുന്നു. ക്യാമറ ഫ്ലാഷുകൾ മിന്നുന്നു.

പക്ഷേ റോബർട്ട് ടിമ്മിനും ജോൺ കുക്കിനും അനങ്ങാൻ കഴിഞ്ഞില്ല. കാലുകൾ മരവിച്ചിരിക്കുന്നു. പേശികൾ ചലിക്കുന്നില്ല. അവരെ വിമാനത്തിൽ നിന്ന് എടുത്തു പുറത്തിറക്കേണ്ടി വന്നു.
ആശുപത്രി കിടക്കയിൽ കിടക്കുമ്പോൾ ജോൺ കുക്ക് മേൽക്കൂരയിലേക്ക് നോക്കി പറഞ്ഞു:

 "ഇനി ഒരിക്കലും... ഒരിക്കലും ഞാനൊരു വിമാനത്തിൽ കയറില്ല."

അതൊരു സത്യമായിരുന്നു. റെക്കോർഡുകൾ പുസ്തകങ്ങളിൽ എഴുതപ്പെടും. പക്ഷേ ആ 65 ദിവസങ്ങൾ അവരുടെ ആത്മാവിൽ ഏൽപ്പിച്ച മുറിവുകൾ, ആ ഭയം, ആ ഏകാന്തത... അത് മരണം വരെ അവരെ വേട്ടയാടിക്കൊണ്ടേയിരുന്നു.
ആകാശത്തെ ജയിച്ചവർ... പക്ഷേ സ്വന്തം മനസ്സിനെ അവർക്ക് അവിടെ ബലികൊടുക്കേണ്ടി വന്നു.
അന്ന് അവർ അവിടെ സ്ഥാപിച്ച റെക്കോർഡ് ഇന്നുവരെ ലോകത്തിലെ ഒരു മനുഷ്യനാലും തകർക്കപ്പെട്ടിട്ടില്ല ഇനിയും അത് തകരുമോ എന്നും സംശയമാണ്...

1. Introduction: When Criminal Law Refuses to Bend to Public Certainty

The Sessions Court judgment in SC No.118/2018, widely known as the Pulsar Suni case, is destined to occupy a permanent place in Indian criminal law discourse. While the conviction of Accused Nos.1 to 6 was widely accepted as a reaffirmation of judicial commitment to women’s safety and bodily autonomy, the acquittal of Accused No.8 (Gopalakrishnan) unsettled public confidence and reignited a perennial debate: why does criminal law sometimes allow a seemingly culpable person to walk free?

This article takes a deliberately forthright and opinionated, yet legally disciplined position: Accused No.8 did not escape because the law is porous, nor because courts were indulgent, but because criminal law is structurally incapable of punishing suspicion, narrative coherence, or public belief

The real failure lies elsewhere - in investigation, evidentiary strategy, and prosecutorial execution.

This study is written not as a reactionary piece, but as a long-form analytical resource for lawyers, judges, law students, investigators, and future researchers examining conspiracy law and appellate restraint.


2. The Prosecution Narrative Against Accused No.8: A Case Built on Motive

The prosecution projected Accused No.8 as the intellectual and financial originator of the crime — the man who conceived the offence but remained physically distant from its execution. The alleged motive was personal and emotionally charged: humiliation arising from the victim’s disclosure of an alleged illicit relationship, leading to marital discord, reputational damage, and a desire for revenge.

The prosecution alleged that Accused No.8:

  • Hatched a criminal conspiracy with Accused No.1
  • Financed the crime through staged monetary payments
  • Directed the recording of sexually explicit visuals
  • Sought not merely physical harm, but long-term character assassination

At a narrative level, the story appeared coherent. At a legal level, however, the case rested almost entirely on inference, association, and motive — elements which criminal law treats with extreme caution.


3. Criminal Conspiracy in Indian Law: A High and Deliberate Threshold

Indian courts have repeatedly emphasized that conspiracy is one of the most dangerous charges in criminal law. It is easy to allege, difficult to disprove, and capable of ensnaring individuals without physical involvement. For this very reason, courts insist on a high evidentiary threshold.

To sustain a conviction for conspiracy, the prosecution must prove:

  • A clear agreement to commit an illegal act
  • Conscious and knowing participation
  • A complete chain of circumstances excluding innocence

In the present case, the Sessions Court correctly distinguished between:

  • What may appear morally convincing
  • What is legally demonstrable beyond reasonable doubt

This distinction — often misunderstood by the public — became decisive in Accused No.8’s acquittal.


4. The Narrow Edge of Law: Where the Prosecution Case Collapsed

Accused No.8 did not benefit from a legal loophole. He benefited from the prosecution’s inability to cross the final evidentiary bridge. The Sessions Court refused to convert suspicion into certainty or assumption into proof.

The court declined to:

  • Treat motive as a substitute for evidence
  • Infer agreement without independent corroboration
  • Supply missing links through judicial imagination

This refusal is not judicial weakness — it is constitutional discipline.


5. Opinionated Assessment: The Acquittal Was Inevitable

From a strictly legal perspective, the acquittal of Accused No.8 was not merely justified — it was inevitable. Any other conclusion would have required the court to dilute the standard of proof and compromise foundational principles of criminal justice.

Courts are not instruments of social retribution. They are guardians of due process. When investigation fails to meet legal standards, acquittal is not injustice; it is necessity.


6. Investigation Lapses: The True Fault Lines in the Case

(a) Failure to Establish an Unbroken Financial Trail

The prosecution alleged multiple payments, yet failed to establish a clear, documented, and causally linked financial trail. In modern conspiracy prosecutions, financial forensics is not optional. The absence of irrefutable banking or transactional proof severely weakened the case.

(b) Improper Reliance on Statements of Co-Accused

Despite settled law under the Evidence Act, the investigation relied heavily on statements and alleged confessions of co-accused. Such material is inherently weak and legally insufficient unless independently corroborated.

(c) Absence of Proof of Direction or Command

No evidence demonstrated that Accused No.8 exercised command, supervision, or operational control. Conspiracy cannot be inferred merely because the accused stood to benefit.

(d) Digital Evidence Left Underdeveloped

In an era of ubiquitous digital footprints, the lack of decisive electronic evidence linking Accused No.8 to execution-stage decisions was a glaring omission.

(e) Prosecution Strategy Overvalued Narrative Consistency

The investigation appeared to prioritize storytelling over evidentiary robustness. Criminal courts do not convict on plausibility — they convict on proof.


7. Public Perception vs Criminal Proof: A Necessary Disconnect

The discomfort surrounding this acquittal stems from a fundamental misunderstanding. Public perception operates on probability and intuition. Criminal law operates on certainty.

This disconnect is not a flaw. It is a safeguard against wrongful conviction.


8. Appellate Prospects: Can the Acquittal Be Disturbed?

The scope for interference with an acquittal is deliberately narrow. Appellate courts intervene only where findings are perverse, irrational, or based on complete misreading of evidence.

In the present case:

  • The Sessions Court delivered a reasoned judgment
  • No material evidence appears to have been ignored
  • The prosecution case was inherently incomplete

Unless new evidence or grave legal error is demonstrated, the acquittal of Accused No.8 is likely to withstand scrutiny even before the Supreme Court.


9. Lessons for Investigators, Prosecutors, and Policymakers

This case offers enduring lessons:

  • High-profile cases demand higher investigative rigor
  • Conspiracy must be proved, not narrated
  • Public outrage cannot substitute legal proof
  • Judicial restraint is a constitutional obligation

10. Conclusion: Escaped on the Edge, Not Through a Gap

Accused No.8 may appear to have escaped, but legally he passed through the narrowest passage criminal law allows — the passage of reasonable doubt.

This judgment will stand as a lasting reminder that when investigation falters, even the strongest suspicion collapses under constitutional scrutiny.

The edge of criminal law is sharp. It protects society from crime, and individuals from conjecture.

 " അവരുടെ കൂടെ ഉള്ള രംഗങ്ങൾ ഒക്കെ ഞാൻ അവരോടൊപ്പം നിന്നു തന്നെ ചെയ്തോളാം എന്തെന്നാൽ അവരുടെ മുഖത്ത് വരുന്ന ഭാവങ്ങളോട് അപ്പോൾ തന്നെ പ്രതികരിച്ചില്ലെങ്കിൽ പിന്നെ പിടിക്കാൻ  വലിയ പാടാണ് "

അവസാന ആശ്രയമായി കണ്ട കാമുകനും കയ്യൊഴിഞ്ഞപ്പോൾ , ആരുമില്ലാതെയായ രാധ പാളത്തിലൂടെ ചൂളം വിളിച്ചു വരുന്ന ട്രെയിന് മുന്നിൽ ചാടി ജീവിതം അവസാനിപ്പിക്കാൻ ശ്രമിക്കുമ്പോൾ മുറച്ചെറുക്കൻ ദിവാകരൻ വന്നു രക്ഷിക്കുന്നു എന്ന സ്ക്രിപ്റ്റിൽ,

 ട്രെയിന് മുന്നിൽ ചാടി മറിക്കാൻ ശ്രമിച്ച രാധയെ ദിവാകരൻ പിടിച്ചു മാറ്റി രക്ഷിച്ചു കഴിഞ്ഞിട്ടും കഥാപാത്രത്തിൽ നിന്നും ഇറങ്ങി വരാനാകാതെ അയാളിൽ നിന്നും കുതറി മാറി ട്രെയിന് മുന്നിലേക്കു ചാടാൻ ശ്രമിക്കുന്ന അവരെ കണ്ടു മനോജ് കെ ജയൻ പറഞ്ഞ

 "   എടൊ ഇത്  വെറും അഭിനയം ആണ്,  താൻ എന്താ ഈ കാണിക്കുന്നെ ഞാൻ പിടിച്ചില്ലെങ്കിൽ താൻ ഇപ്പോൾ ട്രെയിന് മുന്നിൽ ചാടി മരിച്ചേനെലോ  "

പ്രപഞ്ചമാകെ പ്രകാശം പരത്തി കൊണ്ടിരുന്ന നക്ഷത്രത്തിൽ നിന്നും ഒറ്റ മുറിയിരുട്ടിൽ വെളിച്ചം സൃഷ്ടിക്കുന്ന മിന്നാമിനുങ്ങിലേക്കു സന്തോഷത്തോടെ  പതിനഞ്ചു വര്ഷങ്ങളോളം പരകായ പ്രവേശം ചെയ്തൊരാൾ .......

From dynastic politics to policy indecisiveness, and even allegations of foreign influence, Congress's actions and inactions have led many to ask a provocative question: Has Congress pulled India back from developing?

🚀 1991 Economic Reforms: The Beginning of a Missed Opportunity

The year 1991 was a watershed moment in Indian economic history. Faced with a balance of payments crisis, India had less than three weeks’ worth of foreign exchange reserves left. This crisis prompted the Congress-led government under Prime Minister P.V. Yet, over the years, Rahul’s political journey has come to symbolize a series of missed opportunities, contradictory messaging, and strategic miscalculations. His rise to prominence has not revitalized the Congress Party but instead exposed deeper fractures in its leadership model.

Rahul Gandhi was expected to:

One of the most persistent criticisms leveled against the Indian National Congress in the post-Independence era—particularly in recent decades—is its deep entrenchment in dynastic politics. Unlike other democracies where leadership is shaped through performance, internal elections, and grassroots mobilization, the Congress continues to orbit around the Nehru-Gandhi family, often at the cost of talent, innovation, and democratic vitality.

From Jawaharlal Nehru to Indira Gandhi, Rajiv Gandhi, Sonia Gandhi, and now Rahul and Priyanka Gandhi, the party’s top leadership has been firmly rooted in a single family. While these individuals have undoubtedly shaped Indian politics, the Congress's increasing dependence on dynastic legitimacy rather than institutional strength has distorted its internal democratic processes.

  • Organizational elections are rare, and when conducted, they are often ceremonial.
  • Decision-making is top-down, with limited space for dissent or innovation from grassroots or mid-level leadership.
  • Appointments and responsibilities are often assigned based on proximity to the family, rather than competence or fieldwork.

📉 Merit Crushed, Leaders Pushed Out

This dynastic culture has led to the exit of several talented and ambitious leaders who felt sidelined or ignored:

🚪 Notable Examples:

·         Himanta Biswa Sarma: Once a key Congress leader in Assam, Sarma left after being repeatedly overlooked by the central leadership. Joining BJP, he transformed the party’s position in the Northeast and now serves as Assam’s Chief Minister.

·         Jyotiraditya Scindia: Despite strong public appeal and administrative experience, Scindia was denied adequate leadership space in Madhya Pradesh. His eventual move to the BJP not only toppled the Congress government in the state but also elevated him to a Cabinet post at the Centre.

·         Captain Amarinder Singh: A two-time Chief Minister and a military veteran, Amarinder was abruptly removed from the Punjab CM post reportedly without proper consultation—leading to his departure and the weakening of Congress in the state.

·         Shashi Tharoor: A globally respected intellectual, diplomat, and three-time MP from Kerala, Tharoor has often been treated as an outlier within Congress. Despite his credibility, mass appeal, and reformist outlook, he was undermined during the 2022 Congress Presidential election. Although he bravely contested against the official nominee backed by the Gandhi family, the inner party machinery clearly favored status quo over change.

These leaders represent a cross-section of talent across regions and ideologies—leaders who could have played a transformative role if allowed to rise through a meritocratic system.

The excessive concentration of authority within the Gandhi family has created several problems:
